Early Access Terms

Effective date: October 12, 2026

Thank you for helping us test Zybron. These Early Access Terms (the “Terms”) apply when you are invited to use a pre-release version of Zybron, on the web, on the Mac, or on iPhone and iPad through Apple TestFlight (the “Services”). “Zybron”, “we”, and “us” mean Zybron AI Corp., a Texas corporation. “You” means the person testing and, if you test for an organization, that organization.

Your invitation email links to these Terms. By signing in to Zybron, you agree to these Terms. Accepting an invitation or using the Services in any other way also means you agree. If you do not agree, do not sign in. We keep a record of each invitation we send, including the link to these Terms and the date. If we update these Terms, we may send a new invitation, and signing in after that means you agree to the updated Terms. Section 20 requires disputes to be resolved by individual arbitration in Texas and waives class actions and jury trials. Section 17 limits Zybron's liability to zero dollars.

1. Who can test

2. What early access is

3. Your invitation and account

4. No cost

Early access is free of charge. There is nothing to buy in the app, and testing does not commit you or your organization to any purchase.

5. No expectation of privacy

Do not expect privacy in anything you enter, say, or create during early access. We read what testers do in Zybron to test and improve the system. That includes the full text of your conversations, voice recordings and their transcripts, the documents and other artifacts you create, and the system's records of how it reached each answer. Anyone on the Zybron team working on the system may see it. You consent to this review.

Your content is processed by the providers listed in our Privacy Policy, including the AI model providers that process requests. We do not sell it. These Terms do not take away any right you have under a privacy law that cannot be waived by agreement.

6. Voice and transcription testing

Zybron lets you talk to it, including through Apple CarPlay. While we test, we record what you say and keep the audio together with its transcript so we can test and improve transcription and spoken answers. By using voice, you consent to being recorded and to our review of those recordings. Do not use voice where other people can be heard unless they have agreed to be recorded. You are responsible for getting that agreement.

7. What to keep out

Use information that is suitable for a test. Do not enter or say:

8. Not advice, and your use is your responsibility

9. Do not use it for high-risk purposes

Do not use early access to make or control decisions where a mistake could cause death, injury, or serious harm to people, property, or the environment. This includes emergency response, medical diagnosis or treatment, operating vehicles or equipment, and the control of industrial processes or safety systems.

10. Output about people and the world

Output may contain wrong statements about real people, organizations, places, or events. Do not publish or share output as fact without checking it yourself. Some output draws on outside sources such as public data, maps, and web results. We do not control those sources and are not responsible for them.

11. Your content

Content you put into the Services stays yours. You confirm that you have the right to use and share it with us, and that it does not infringe anyone's rights or break the law. You give us a license to host, copy, process, and review it to provide, test, secure, and improve the Services, including the review described in Section 5.

12. Your feedback, and no ownership

Feedback is the reason for early access, and we welcome all of it: what works, what does not, and what is missing. You agree that we may use your feedback, ideas, and suggestions in any way, including to improve Zybron, without owing you anything for it. We will not name you or your organization publicly in connection with your feedback without asking first.

Feedback gives you no ownership. Nothing you tell us, suggest, or report, and nothing you do while testing, gives you any ownership, license, or other right in Zybron, its software, tools, or intellectual property, including anything we build that reflects your feedback. Zybron owns the Services and everything in them, except your content.

13. Keep early access confidential

What you see during early access is confidential. You must not publish or share screenshots, recordings, or descriptions of the Services or unreleased features without our written permission. This does not apply to anything Zybron has already made public, to your own content, or to disclosures the law requires.

14. Use it fairly

15. Third-party services and Apple TestFlight

The Services rely on third-party providers, including cloud hosting, AI models, maps, and public data. Their own terms may apply, and we are not responsible for them. If you test on Mac, iPhone, or iPad, Apple's TestFlight terms also apply. Test builds expire after a period Apple sets. If you choose to share crash reports or feedback through TestFlight, Apple passes them to us.

16. No warranties

The Services and all output are provided “as is” and “as available”, with all faults. To the fullest extent the law allows, Zybron disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

17. Limitation of liability

You use early access at your own risk. To the fullest extent the law allows:

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or gross negligence.

18. You cover our costs for your misuse

You will defend, indemnify, and hold harmless Zybron and its officers, employees, and contractors from any claim, loss, or cost, including reasonable attorneys' fees, arising from your content, your use of the Services or their output, your breach of these Terms, or your violation of any law or anyone's rights.

19. Time limit for claims

Any claim arising from or related to early access must be brought within one year after it arose, or it is permanently barred, to the extent the law allows.

20. Disputes: arbitration and class action waiver

21. Governing law and courts

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any matter that is not arbitrated will be heard only in the state or federal courts located in Harris County, Texas, and you and Zybron consent to their jurisdiction.

22. If your organization has an agreement with Zybron

If your organization has a signed agreement with Zybron, that agreement governs your organization's production use. For early access, these Terms apply, including Sections 5 and 6, unless that agreement says in writing that it overrides these Terms for testing.

23. How these Terms fit with our other policies

These Terms add to our Terms of Use and Privacy Policy. If they disagree, these Terms apply to your early access.

24. When testing ends

When early access ends, for you or for everyone, your access to the pre-release version stops. Sections 5, 6, 8, 10 through 13, and 16 through 25 continue to apply.
